1. ACCEPTANCE OF TERMS
Welcome to GoodTherapy.org. GoodTherapy.org provides the GoodTherapy.org Continuing Education Program ("Program Service") to qualifying employees and contractors (“Users”) of participating Mental Health Clinics subject to the following Terms of Service. By registering for the Program Service, you, a User of this Program Service, agree to be bound by these Terms of Service. Please read them carefully. If you do not agree to these Terms of Service, please do not register for or use the Program Service. You can review the most current version of the Terms of Service at any time at: https://www.goodtherapy.org/ce-user-terms-service.html. GoodTherapy.org reserves the right to modify these terms in its sole discretion. Such modified terms shall take effect upon the date posted at the website above.
2. DESCRIPTION OF SERVICE
GoodTherapy.org provides a paid Program Service to qualified Users (employees and/or contractors of the Mental Health Clinic who are licensed or pre-licensed therapists, counselors, social workers, psychologists, physicians, or nurse practitioners). This Program service provides to Users:
- Access to at least 50 units of live continuing education teleconferences, web conferences or webinars annually. All of which are approved by the American Psychological Association, the National Board of Certified Counselors, and the Board of Behavioral Sciences.
- Access to additional live teleconferences, web conferences, or webinars per calendar month, which are not approved by the American Psychological Association, the National Board of Certified Counselors, and the Board of Behavioral Sciences.
- Access to the GoodTherapy.org Archive of recorded teleconferences, web conferences or webinars. These are provided in audio or video formats. As of March 2013, there are over 170 hours of recorded continuing education available in the archive.
- Access to downloadable CE certificates in PDF form with the completion of required survey and, in some cases, an additional exam. Exams are required for all Users requesting a certificate for which they have not attended the live event or have waited more than six days after the live event to request their CE certificate.
This Program Service may include weekly or biweekly service announcements and/or administrative messages from GoodTherapy.org by email. These communications are considered part of the Program Service, and User will not be able to opt out of receiving them.
3. AGREEMENT:
User agrees that GoodTherapy.org is under no obligation to User except to provide, as part of the Program Service, continuing education events approved by the APA, NBCC, and BBS, maintain an archive of past continuing education events, provide access to all live and archived events to all therapists of the Mental Health Clinic, and allow access to downloadable CE certificates approved by the APA, NBCC, and BBS.
User acknowledges that GoodTherapy.org makes no representations or warranties of any kind, either expressed or implied, with regard to THE Program Service, THE GOODTHERAPY.ORG website, its content, or its operations. To the fullest extent of the law, GoodTherapy.org, disclaims all warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Program Service Continuing Education Events and ALL content available on GoodTherapy.org are provided on an AS-IS, AS-AVAILABLE basis and are not intended to be, in any way, a substitute for professional advice, diagnosis, medical treatment, or psychotherapy. Always seek the advice of your physician or other qualified mental health provider with any questions you may have regarding any mental health symptom or medical condition. Never disregard professional psychological or medical advice, nor delay in seeking professional advice or treatment because of something you have read on GoodTherapy.org.
User agrees to provide true, accurate, current and complete information about User as prompted by the Program Service's sign up procedure (registration) and to maintain and update their account to keep it true, accurate, current and complete. User agrees that all information, both private and public, entered by the User and stored by GoodTherapy.org may be transferred and shared in the event that GoodTherapy.org should be sold to, merged with, or given to another organization, corporation, or individual.
As a condition precedent to GoodTherapy.org providing the services herein, User must be an employee or legally contracted provider for a Mental Health Clinic, group, or agency which has paid for the services provided. User shall no longer be eligible to receive the services herein if User is no longer an employee or legally contracted provider for a Mental Health Clinic, group, or agency, or if the Mental Health Clinic, group, or agency has ceased payment for the services. User may not share the services provided herein with any other person or entity.
User agrees to choose an email/username and password as part of the Program Service registration process. User is responsible for maintaining the confidentiality of the password and account, and is fully responsible for all activities which occur under your password, account, or Program service. User agrees to immediately notify GoodTherapy.org of any unauthorized use of your password(s) or account(s), or any other breach of security, and ensure that you exit from your account at the end of each session.
It is GoodTherapy.org's intention to provide all Users with access to each Web Conference for which they have registered. However, due to potential technical complications, presenter schedules and availability, Acts of God, or other unforeseen circumstances, registration for any Web Conference is in no way a guarantee of access or participation in the Web Conference.
User agrees that GoodTherapy.org, has no liability of any kind whatsoever to the User or to any individual, group, partnership, or corporation who may use the Program Service.
User agrees to indemnify, defend, and hold harmless GoodTherapy.org against any loss or liability resulting from the use of the Program Service, including, but not limited to, any claims by third parties who may use your service(s).
User acknowledges that participation in the Program Service is wholly voluntary, and responsibility for determining appropriateness of the content is fully at the User’s own discretion.User agrees to assume all liability for the content User is exposed to as a result of participating and attending GoodTherapy.org continuing education events and the User agrees to assume any and all responsibility for claims occurring therefrom against GoodTherapy.org.
User agrees to indemnify, hold harmless, and defend GoodTherapy.org and its licensors, suppliers, officers, directors, employees, agents, affiliates, and subsidiaries from and against any and all liability, loss, claim, damages, expense, or cost (including but not limited to attorneys' fees), incurred by or made against the Indemnified Parties in connection with any claim arising from or related to your use of the Program Service or GoodTherapy.org website, the placement, posting or transmission of any messages, information, Content, or other materials on or through the GoodTherapy.org website, or any breach or violation of these Terms of Service by you.
User agrees that GoodTherapy.org has the right to suspend or terminate its Program Service and refuse any and all current or future use of the Service for any cause and without prior notice. User agrees that GoodTherapy.org reserves the right at any time and from time-to-time to modify or discontinue, temporarily or permanently, the Program Service (or any part thereof) with or without notice. You agree that GoodTherapy.org shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
User acknowledges that if and when the account of the Mental Health Clinic for which they are employed or contracted by is no longer active due to the Mental Health Clinic’s own cancellation or termination by GoodTherapy.org, the Mental Health Clinic and its Users will no longer have access to the online member’s area, nor will copies of previously earned CE certificates be available. Likewise, should the User deactivate their User account for any reason, the User will no longer have access to the online member’s area nor will copies of previously earned CE certificates be available. Users are advised to download and store all of their earned CE certificates locally prior to cancelling.
User agrees that GoodTherapy.org shall have the right, in its sole discretion, to promote the GoodTherapy.org Program Service through various partnerships, promotional activities, advertising, and through direct use of the GoodTherapy.org Program Service by selected partner websites which GoodTherapy.org deems useful, effective, and in the interest of GoodTherapy.org and its Mental Health Clinics.
User agrees that the Program service provided to User will not be sublet to others, nor used for other purposes than herein named.
User agrees that any links to third party sites are provided solely for convenience. Such sites are not under the control of GoodTherapy.org, and GoodTherapy.org is not responsible for their content, any changes or updates to them, or the collection of any personal data or information by the operators of such sites.
User agrees that advertisers and sponsors are not related to GoodTherapy.org other than by a business relationship. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Program Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such advertiser. User agrees that GoodTherapy.org shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings, products, or services, or as the result of the presence of such advertisers on the Program Service or website.
User consents to receive communications from GoodTherapy.org electronically. GoodTherapy.org will communicate with User by email or by posting notices on this site. User agrees that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
User agrees to not use the Program Service or any other functions on the GoodTherapy.org website to:
- upload, post, email, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
- upload, post, email, transmit, or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
- upload, post, email, transmit, or otherwise make available any Content that infringes upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
- intentionally or unintentionally violate any applicable local, state, national, or international law.
- create a competing website offering the same or substantially similar services to those provide through our Website or Service.
- decompile, disassemble, or reverse engineer our Website, Service, and any related software found herein.
- re-distribute our Content in any manner including, but not limited to, sale, license, lease, rental, subscription, or any other distribution mechanism
User agrees that these Terms of Service, the Program Service, and the placement and publication of information and content on the GoodTherapy.org website are governed be the laws of the State of Alaska, without regard to its conflict of law principles. User agrees that the City of Anchorage, and the Municipality of Anchorage, in which GoodTherapy.org is located, shall be the forum for any legal action relating to our Website, Content, Program Service, and listings placed or published. Any cause of action by you with respect to our Website, Content, or Program Service, must be instituted within one (1) year after the cause of action arose or be forever waived and barred. Should any part of these Terms of Service be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any Content is in conflict or inconsistent with these Terms of Service, these Terms of Service shall take precedence. The failure of GoodTherapy.org to enforce any provision or right of these Terms of Service will not constitute a waiver of such provision or right.
User also acknowledges the existence of the Terms of Service and Use Agreement which outlines the service and use conditions applicable to all users of GoodTherapy.org and agrees, by virtue of visiting GoodTherapy.org, to all of the conditions contained in the Terms of Service and Use Agreement.
These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
