This seminar will first briefly review sources of legal and ethical guidance and the necessary components of valid, binding informed consent procedures. From there, we will sort through the legal distinctions and complexity of duties regarding reporting sexual abuse, rape, and statutory rape with case examples. Included in this discussion will be general issues regarding the confidentiality rights of minors and responsibilities surrounding the management of self-injurious behavior.

Duty to warn issues will then be discussed with an examination of the divergences in legal and ethical definitions and the binds that are created for the mental health professional when faced with the decision to act or not. Case examples will be discussed in the context of these dilemmas. Time permitting, other current issues such as right-to-die/end-of-life decisions, elder abuse, and the ambiguity of the language of the codes will be addressed. Time for questions and answers will be provided.

This web conference is advanced instructional level and designed to help clinicians:

  1. Explain the factors that make informed consent legal and binding;
  2. Compare the differences between rape, statutory rape, and child abuse and the accompanying obligations under the ethical codes and the law;
  3. Describe the duties and responsibilities regarding client self-mutilation;
  4. Analyze the complexity of duties and responsibilities regarding duty to warn;
  5. Discuss current issues and codes regarding end-of-life decisions and elder abuse.

How the Web Conference Works

Attendees who register for this event will log in to the web conference center by using a computer and calling in to the teleconference line. Attendees will be able to ask live audio questions via phone and/or submit text chat questions via computer. Live streaming video and/or document sharing will also be available to participants. Alternatively, attendees may dial in to the teleconference line only, though attendees dialing in by phone only will be unable to ask questions.

Clifton Mitchell, PhD

Clifton Mitchell, PhD, is a licensed psychologist who loves to teach. He has over 20 years of experience as a trainer and keynote speaker and 15 years of experience teaching and writing on ethical and legal issues. He specializes in helping people understand and manage difficult and perplexing ethical and legal issues. His latest training in this arena incorporates an educational game-show format. Dr. Mitchell works as a counseling professor at East Tennessee State University, where he was awarded “Teacher of the Year” in 2002.

Dr. Mitchell is the author of Effective Techniques for Dealing with Highly Resistant Clients, and his articles appear in popular publications and professional journals such as Perceptual and Motor Skills, Barron’s Financial Weekly, Journal of Personality Assessment, Psychology and Education, The Advocate, and Men’s Health Today.
