He is struggling to get up in the morning, complete daily living tasks, and concentrate at work. Jake needs to take some mental health days off to stabilize his <a href=\"https:\/\/www.goodtherapy.org\/blog\/psychpedia\/mood\">mood<\/a>, but he\u2019s unsure how his employer will handle his request.<\/p>\n<p>Also working with me in therapy\u00a0is Sarah, a\u00a0person with a <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/disabilities\">chronic illness<\/a> who is unemployed but wants to work part-time to contribute to her family. She experiences unexpected pain and fatigue that can be debilitating, sometimes confining her to bed all day. Sarah isn\u2019t sure if she should tell her potential employer in the interview about her condition, fearing she will not be hired.<\/p>\n<p>Does either of these situations resonate with you due to a mental or physical <a href=\"https:\/\/www.goodtherapy.org\/blog\/psychpedia\/diagnosis\">diagnosis<\/a>? Are you afraid to tell your employer about your condition out of fear you will be treated unfairly? If so, you are not alone. Certainly, there are risks to disclosing; you leave yourself vulnerable to those around you and risk being treated differently or unfairly. But there are dangers to not telling, too. If you don\u2019t disclose your condition\u2019s symptoms to your employer, you run the risk of being seen as incompetent or lazy at your job, which could lead to negative consequences. And if you don\u2019t disclose important information, you may not be protected legally in the event of <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/prejudice-discrimination\">discrimination<\/a>.<\/p>\n<p>What are your rights, you ask? The <a href=\"https:\/\/www.goodtherapy.org\/blog\/psychpedia\/americans-with-disabilities-act\">Americans with Disabilities Act (ADA)<\/a> protects you from any potential consequences and requires employers to make reasonable accommodations for anyone with a condition it defines as a \u201cdisability.\u201d<\/p>\n<p><span class=\"popout-quote-left\" style=\"font-weight: bold; width: 30%; float: left;\">Certainly, there are risks to disclosing; you leave yourself vulnerable to those around you and risk being treated differently or unfairly. But there are dangers to not telling, too.<\/span><\/p>\n<p>The term &#8220;disability&#8221; is defined by the U.S. Department of Labor as:<\/p>\n<ul>\n<li>A physical or mental impairment that substantially limits one or more major life activities<\/li>\n<li>A record of a physical or mental impairment that substantially limits one or more major life activities, or<\/li>\n<li>Being regarded as having a physical or mental impairment that substantially limits one or more major life activities<\/li>\n<\/ul>\n<p>Likewise, a mental health disability is \u201ca mental impairment that substantially limits a major life activity.\u201d Some common mental health conditions include depression, <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/bipolar\">bipolar<\/a>, <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/ptsd\">posttraumatic stress (PTSD)<\/a>, <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/ocd\">obsessive compulsion (OCD)<\/a>, <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/panic\">panic<\/a>, and <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/schizophrenia\">schizophrenia<\/a>.<\/p>\n<p>Common challenges include:<\/p>\n<ul>\n<li>Maintaining regular attendance<\/li>\n<li>Dealing with the change of starting a new job<\/li>\n<li>Nervousness about interacting with others<\/li>\n<li>Understanding how to manage time<\/li>\n<li>Organizing information<\/li>\n<li>Handling <a href=\"https:\/\/www.goodtherapy.org\/learn-about-therapy\/issues\/stress\">stress<\/a> and <a href=\"https:\/\/www.goodtherapy.org\/blog\/psychpedia\/emotion\">emotions<\/a><\/li>\n<li>Maintaining focus<\/li>\n<\/ul>\n<p>Ultimately, disclosing your disability to your employer is a personal decision. It might be helpful for you to <a href=\"https:\/\/www.goodtherapy.org\/find-therapist.html\">find support<\/a> in making this decision. Your choice to tell can change depending upon the situation and the need for an accommodation.
