Rules, Terms, and Conditions

 

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PARTICIPATING IN THE THERAPY AWARD SCHOLARSHIP.

This document is the Rules, ("Rules"), Terms ("Terms"), and Conditions Agreement ("Agreement") for the Good Therapy Foundation's Therapy Award Contest, sponsored by GoodTherapy.org. By participating in the scholarship and using the GoodTherapy.org website, you agree to fully comply with and be bound by the following Agreement. Please review the following terms and rules carefully. If you do not agree to any of these Terms, then please do not participate in the scholarship.

Therapy Award Scholarship Rules, Terms, and Conditions of Agreement

  1. NO PURCHASE NECESSARY. A purchase of a product or service from Good Therapy Foundation or GoodTherapy.org, or any of its affiliated companies will not improve the chance of winning. Void where prohibited. Subject to all federal, state, and local laws. Participation requires Internet access.
  2. PARTICIPATION & ELIGIBILITY GUIDELINES: To participate in the Good Therapy Foundation "Therapy Award Scholarship" you must:

    - be at least 18 years of age or older and a legal resident of the 50 United States or the District of Columbia, including APO/FPO addresses excluding Puerto Rico.

    - provide a minimum 150 word submission entry that includes answers to ALL of the following:

    • What are the obstacles currently preventing you from being able to receive or afford therapy?
    • Why do you want to go to therapy and what issues are you facing or problems are you experiencing?
    • How would you like to benefit from therapy and what are you hoping to achieve?

    - Employees of Good Therapy Foundation and GoodTherapy.org, its parent, subsidiary and affiliated companies, advertising and promotion agencies, web site providers or other parties involved in any aspect with the creation, production, operation, execution and fulfillment of the Scholarship and the immediate family members (parents, siblings, children and spouse) and/or those living in the same household (whether or not related) of each are not eligible to win.

    - Participants are not required to have health insurance to enter the scholarship.

  3. SCHOLARSHIP PERIOD. GOOD THERAPY FOUNDATION "THERAPY AWARD SCHOLARSHIP" will be accepting blog entries online starting at or about 12:00:01 PM (PST) JULY 1, 2011 and ending at 5:00:00 PM (PST) JULY 31, 2011 (The "Scholarship Period"). All online blog entries must be received by 5:00:00 PM (PST) JULY 31, 2011. Participants assume all risk of lost, late, misdirected, or incomplete blog entries. All blog entries submitted through the GoodTherapy.org website become the sole property of Good Therapy Foundation and GoodTherapy.org and will not be returned. The top finalist will be announced by 5:00:00 PM (PST) on AUGUST 8, 2011.
  4. HOW DO I ENTER? One entry allowed per person for those participating in the scholarship. You may enter online from the GoodTherapy.org blog. Submitting an entry requires agreeing to the terms of these Official Rules and all decisions of Good Therapy Foundation and GoodTherapy.org and/or its designee, which are final and binding in all respects. Sponsor is not responsible for incorrect, inaccurate or incomplete entry of information or for blog entries which are garbled, damaged, incompletely received, otherwise defective or lost due to any reason, all of which will be voided. The GoodTherapy.org Therapy Award Scholarship is available through the GoodTherapy.org blog and entries are submitted through commenting on the Therapy Award Scholarship post. The URL of the scholarship post is http://www.goodtherapy.org/blog/therapy-award-scholarship. Participants must scroll to the bottom of the scholarship blog entry and click "Click Here to Leave a Comment", leading to the "Leave a Reply" section of the blog.
  5. ENTRY COMMENT REQUIREMENTS. (a) Entry Comments must be submitted through the GoodTherapy.org Therapy Blog (b) Your entry form must have the following requirements: name or nickname, valid e-mail address, entry title "SCHOLARSHIP ENTRY", and agreement to the rules through checking the "Terms of Agreement" checkbox. (c) In the Entry Comments you must demonstrate: (1) You are choosing to participate in the Good Therapy Foundation "Therapy Award Scholarship." (2) Any language appearing on the Entry Comments must be written in English. (3) Entries must be at least 150 words. There is no maximum word count limit. (4) Entries cannot include any identifying information such as last name, detailed location, etc for participants' own safety and protection.
  6. CONDITIONS APPLICABLE TO ALL ENTRIES. By submitting an entry (or accepting any prize), each Entrant understands and agrees that their Entry Comments and name may be posted online to GoodTherapy.org, without further compensation or review, and will not be returned. Good Therapy Foundation and GoodTherapy.org reserve the right to crop any entry in whole or in part or request submitters to do so, in order to be viewable online. Entrant further agrees to release Good Therapy Foundation and GoodTherapy.org from any and all claims that any such use by Sponsor, including any commercial advertising presentation, web content or any other material subsequently produced, presented and/or prepared by or on behalf of Sponsor, infringes the Entrant's rights with regard to any elements, characters or ideas contained in its Entry.
  7. WHAT CAN I WIN? One (1) Grand Prize. One (1) Grand Prize Winner will receive free therapy sessions for up to six months with a therapist or counselor of their choosing. The prize is worth up to $400 monthly and $2,400 total. The prize can be used for individual, family, group, and/or couples or marriage therapy and counseling. A payment will be made to each Grand Prize Winner's therapist or counselor after an invoice is submitted for services provided. Payment will be made in the form of check or electronic payment made directly to the therapist or counselor chosen by the Grand Prize Winner. Entrant MUST provide Good Therapy Foundation and GoodTherapy.org with the identity of the therapist or counselor they've chosen within 90-days of their selection as the Grand Prize Winner, or by no later than NOVEMBER 6, 2011. In the event that deadlines are not satisfied, the Entrant may forfeit the prize and the prize will not be awarded.

    Prizes cannot be assigned, transferred, exchanged or otherwise redeemed. Sponsor is not responsible for any costs associated with accepting or otherwise using the prize. Acceptance of prize constitutes permission to Good Therapy Foundation and GoodTherapy.org and its agents to use winner's name, likeness, and Entry Comments for purposes of advertising and trade without further compensation, unless prohibited by law.

  8. HOW DO I WIN?  One (1) Grand Prize Winner will be determined and all decisions are final, binding and conclusive on all matters related to the Scholarship. Three attempts to contact the potential Grand Prize Winner by email will be made within 30-days of completion of the voting poll. If a potential Grand Prize Winner is unable to be reached within five (5) days of the third contact attempt, or refuses to accept the prize, the potential Grand Prize Winner will be disqualified and an alternate winner will be selected. Each potential prize winner must sign and return an Affidavit of Eligibility and Liability/Publicity Release ("Prize Documents") within fourteen (14) days of receipt of Prize Documents. Good Therapy Foundation and GoodTherapy.org shall have no liability or responsibility to award any prize where: (a) any required Prize Documents are not fully executed and received by Sponsor at the designated address by the due date specified in Prize Documents; or (b) if any mail addressed to the potential Winner is returned to Sponsor as undeliverable without a forwarding address or if potential Winner cannot be contacted for any reason; or (c) potential Winner is deemed ineligible or otherwise non-compliant with any aspect of these Official Rules. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH INDIVIDUAL'S DISQUALIFICATION AS A WINNER AND ALL PRIVILEGES DUE SUCH INDIVIDUAL WILL BE IMMEDIATELY TERMINATED AND AN ALTERNATE PRIZE WINNER WILL BE SELECTED.
  9. COMMENT SUBMISSION. Each Entrant acknowledges and agrees that (a) Good Therapy Foundation and GoodTherapy.org, and other participants have access to and/or may create or have created media or other materials, ideas and concepts which may be similar or identical to the Entrant's Scholarship Comment Entry in theme, idea, format, characters and/or other respects; (b) Entrant shall not be entitled to any compensation or other consideration because of the use by Good Therapy Foundation or GoodTherapy.org, or any other participant of any such similar or identical material, ideas and/or concepts; and (c) Good Therapy Foundation or GoodTherapy.org or another participant's use of material containing elements similar to or identical with those contained in the Entrant's Scholarship Comment Entry shall not obligate Good Therapy Foundation or GoodTherapy.org to negotiate with nor entitle the Entrant to any compensation or other claim.
  10. CONDUCT. By entering this Scholarship, each Entrant (and/or their parent or legal guardian) agrees to be bound by these Official Rules and by the decisions of Good Therapy Foundation and GoodTherapy.org and its judges and agents, which are final and binding in all matters relating to the Scholarship. Good Therapy Foundation and GoodTherapy.org reserve the right at its sole discretion to disqualify and prohibit any Entrant from participating in the Scholarship or winning a prize who Good Therapy Foundation or GoodTherapy.org suspects, in the sole discretion, of attempting to undermine the legitimate operation of the Scholarship by cheating, hacking, deception, or other unfair playing practices (including the use of automatic quick entry programs) or intending to annoy, abuse or threaten or harass any of the Sponsors' representatives or otherwise failing to comply with these Rules. NOTE: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DAMAGE ANY WEB SITE ASSOCIATED WITH GOOD THERAPY FOUNDATION AND GOODTHEARPY.ORG OR ITS AGENTS OR UNDERMINING THE LEGITIMATE OPERATION OF THE SCHOLARSHIP IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  11. RELEASE OF LIABILITY. The winner, by acceptance of the prize, agrees on behalf of him/herself, his/her heirs, executors, representatives, assigns, administrators and next of kin to indemnify, hold harmless and release Good Therapy Foundation and GoodTherapy.org, its parent, subsidiary and affiliated businesses and each of their officers, directors, shareholders, employees, advisors, assignees, agents, representatives and any other person or entity associated with this Scholarship from any and all liability claims or actions of any kind with respect to or in any way arising from this Scholarship, participation in any Scholarship-related activity; and/or delivery/misdelivery, acceptance, possession, use, or misuse of a prize, including, but not limited to, liability for personal injury, bodily injury (including wrongful death or disability), damage to property, and damage or loss of any other kind. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or used in the Scholarship or by any technical or human error that might occur in the processing of Scholarship Entries. Good Therapy Foundation and GoodTherapy.org assumes no responsibility for any error; omission; interruption; deletion; defect; delay in operation or transmission; communications-line failure; or theft, destruction, unauthorized access to, or alteration of Entries. Good Therapy Foundation and GoodTherapy.org are not responsible for any problems or technical malfunction of any telephone network or lines; computer online systems, servers, or providers; computer equipment; software; or failure of e-mail or entry on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participant's or to any person's computer related to or resulting from participating in this Scholarship, downloading materials from Good Therapy Foundation or GoodTherapy.org's Web site or emailing entries. Good Therapy Foundation and GoodTherapy.org are not responsible for cheating or fraud by any participant. Any activities intended to disrupt or interfere with the proper play of the Scholarship or defraud Good Therapy Foundation or GoodTherapy.org in any way will be prosecuted to the fullest extent of the law. Participants who engage in any of the foregoing activities will be disqualified and will forfeit any prize won. If, for any reason, the Scholarship is not capable of running as planned, due to, without limitation, infection by computer virus, worm, or bugs; tampering; unauthorized intervention; fraud; technical failures; or any other causes beyond the control of Good Therapy Foundation or GoodTherapy.org that, in the sole opinion of Good Therapy Foundation or GoodTherapy.org, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Scholarship, Good Therapy Foundation and GoodTherapy.org reserve the right, at their sole discretion, to cancel, terminate, modify, or suspend the Scholarship. Good Therapy Foundation and GoodTherapy.org are not responsible for any typographical or other error in the printing of these Official Rules or any materials associated with the administration of the Scholarship or the announcement of the prize. In all events, the sole maximum liability of Good Therapy Foundation and GoodTherapy.org and its affiliates shall be limited to any of the prize(s) set forth herein.
  12. CHOICE OF LAW. Except where prohibited by law, all issues and questions concerning the constitution, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and the Sponsor in connection with this Scholarship, shall be governed by, and construed in accordance with, the laws of the State of Alaska in the U.S., without giving effect to any choice of law or conflict of law rules (whether of the State of Alaska, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Alaska in the U.S.
  13. PRIVACY. Information Entrants provide to Good Therapy Foundation and GoodTherapy.org will be used to communicate with Entrants regarding this Scholarship and otherwise as set forth in these Official Rules, as well as to contact Entrants at a later date with respect to other products and services and product enhancements which Good Therapy Foundation and GoodTherapy.org believes may be of interest to them. By submitting a blog entry comment on-line to Good Therapy Foundation and GoodTherapy.org, all Entrants acknowledge and agree that the personal information that they have provided will be maintained on GoodTherapy.org's server in accordance with GoodTherapy.org's Privacy Policy and Terms of Service.
  14. PUBLICITY CONSENT. By submitting a blog comment entry or accepting a prize, where permitted by law, each participant grants to Good Therapy Foundation and GoodTherapy.org (and agrees to confirm that grant in writing) and those acting pursuant to the authority of Good Therapy Foundation and GoodTherapy.org the irrevocable right without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web, in perpetuity and throughout the universe, his/her Entry, including, without limitation, the entry and winner's name, or statements about the Scholarship, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
  15. SPONSOR. GoodTherapy.org, 200 West 34th Avenue, Suite 501, Anchorage, AK. 99503, sponsors this Scholarship. Sponsor reserves the right to cancel the Scholarship at any time and substitute another promotion in its place.
